These Terms of Service ("Terms") govern your access to and use of the website postbeam.ai and the Postbeam application at app.postbeam.ai (collectively, the "Service"), operated by Postbeam ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use the Service.

1. Eligibility

The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

When you create an account, you agree to:

• Provide accurate, current, and complete information, and keep it up to date.
• Keep your login credentials confidential and not share them with others.
• Take responsibility for all activity that occurs under your account.
• Notify us promptly at team@postbeam.ai if you become aware of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose, or in violation of any applicable law or regulation.
• Copy, modify, reverse engineer, decompile, or attempt to derive the source code of the Service, or use it to build a competing product or service.
• Scrape, harvest, or use bots, scripts, or other automated means to access or extract data from the Service in a manner not expressly permitted by us.
• Interfere with, disrupt, or place an undue burden on the Service, or circumvent any of its security or access controls.
• Use the Service to infringe, misappropriate, or violate the rights of any third party.

4. LinkedIn and Third-Party Platforms

Core features of the Service require you to connect a LinkedIn account. When you use these features, you are responsible for complying with LinkedIn's User Agreement, API Terms of Use, and other applicable policies. Postbeam is an independent product and is not affiliated with, endorsed by, or sponsored by LinkedIn. We are not responsible for third-party platforms, and changes to their APIs, policies, or availability may affect the Service.

5. Subscriptions and Payment

Paid plans are billed according to the plan you select at signup. Payments are processed securely through our third-party payment processor; we do not store credit card numbers on our servers. Subscriptions automatically renew for the same term unless cancelled before the end of the current billing period. Fees are exclusive of taxes, which are your responsibility. Except where required by law, fees are non-refundable.

6. Intellectual Property

The Service and all related software, content, designs, trademarks, and other intellectual property are owned by Postbeam or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription. We reserve all rights not expressly granted to you.

7. Your Content

You retain ownership of the content you create, upload, schedule, or publish through the Service ("Your Content"). You grant us a limited, worldwide, non-exclusive license to host, store, process, and transmit Your Content solely as necessary to provide and improve the Service. You are responsible for Your Content and represent that you have all rights necessary to use it and to grant us this license.

8. Feedback

If you provide us with suggestions, ideas, or other feedback about the Service, you agree that we may use it without restriction or obligation to you, and that such feedback becomes our property.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POSTBEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Postbeam and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, Your Content, or your breach of these Terms or any applicable law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that may cause harm to us or others. Upon termination, your right to access and use the Service will immediately end. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
